This Privacy Policy (the “Policy”) explains how www.rookiekids.com (“Rookie”, “us”, or “we”) collects information from you when you use the website www.rookiekids.com or a Rookie mobile app downloaded from the iTunes App Store or the Google Play Store, both as a website or mobile app user and as a customer, what Rookie KIDS does with the information that Rookie collects, how information is shared and what you can expect from Rookie KIDS regarding the privacy of your information.

PERSONAL INFORMATION WE COLLECT

We collect the following categories of Personal Data 

  • Identifiers. When you voluntarily provide it to us, we collect personal identifiers such as name, phone number, email address, billing address, shipping address, month of birth, and regarding online purchases only, your credit card number. We may also collect Personal Data concerning gift recipients (name and mailing address) for the sole purpose of fulfilling gift orders. We will also create a client number when you sign up to be a Rewards Member of our Rewards Program. 

  • Internet or other network activity information. We collect information such as IP addresses, browsing or search history, your interactions with our emails, and data collected through cookies and similar technologies. 

  • Characteristics of protected classifications under California or federal law. We collect information such as age (including month of birth), and gender. 

  • Personal characteristics and demographic data. We collect personal characteristics such as your footwear size, marital status, household income range, preferred language, and number and ages of children. If you are a Rewards Member and participate in certain programs, we may also collect information related to milestones in your life, such as your birthdate. 

  • Geolocation information. We collect mobile device identifiers and real-time precise geolocation information from mobile app users and visitors’ devices in and around our stores. 

  • Audio, electronic, and visual information. We collect audio, electronic, and visual information such as the messages you submit through rookiekids.com, emails and texts you send us, messages to delivery recipients, delivery instructions, video footage and photographs of the public areas of stores, and call recordings. 

  • Personal Data from publicly available sources as well as other sources, as permitted by law. For example, we may collect information about you from sources such as social media when you choose to provide it to us. 

If you have submitted Personal Information and would like to change that information, please log in to your Rookie KIDS Rewards program account and edit your information. If you are not a member of the Rewards program, you can follow the instructions in the "Opt Out Policy" section below to stop receiving e-mail and/or text communications from Rookie KIDS. 

HOW WE COLLECT INFORMATION 

We collect Personal Data from the following sources. 

  • From You. Rookie receives Personal Data when you purchase items online, sign up for the Rookie Rewards Program, sign up to receive discounts, promotions, and perks, email us or submit an inquiry using the “Contact Us” submission page or through the chat function on our Website or participate in one of our contests, sweepstakes, or online promotions (as applicable). During calls with you (such as when you contact customer service), in our stores (such as when you interact with a salesperson or make a purchase), when you interact with our emails (such as when you respond to our surveys and open and interact with our emails When you use our in-store wi-fi services, download and use our mobile application or operate your device near or in our stores, we obtain information from your device 

  • From Third Parties. Rookie also receives Data from affiliates, service providers, analytics companies, marketing partners, advertising networks, and data companies about you and the different devices you use online (such as demographic information). Social media platforms and networks such as Facebook, Twitter, Pinterest, and Instagram provide public profile information (including personal identifiers, demographic information, interests, and publicly observed data, and visual information (such as your profile photo) about you when you use these platforms in connection with our Website. 

  • Through Tracking Technologies. Rookie collects information through tracking technologies placed on our Website, such as cookies, tags and pixels. 

  • Cookies. A cookie is a piece of data stored on the hard drive of your computer, containing information about you. We and third parties use the following types of cookies on our Website: 

  • Strictly Necessary. These cookies are necessary for the Site to function and cannot be switched off in our systems. 

  • Functional. These cookies enable our Website to provide enhanced functionality and personalization thereby saving time while on our Website. They may be set by us or by third party providers whose services we have added to our pages. Most browsers can be set to reject cookies or to ask you if you want to accept/reject an incoming cookie. If you reject the cookie, you may still use our Website, although you will be limited in some functionality of our Website. 

  • Advertising. These cookies allow us and third parties to learn more about you, including your use of our Website and other websites, and to advertise products or/services that might interest you. 

  • SMS Messaging. These cookies enable personalization of your experience on the Messaging Service (e.g., sending you personalized text messages such as shopping cart reminders). 

  • Performance. We also allow third party companies such as Google Analytics to place beacons, cookies or tags on our Website. Google Analytics utilizes cookies to gather information regarding use of our Site. These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our Website. All information that cookies collect is aggregated and therefore anonymous. If you do not allow these cookies we will not know when you have visited our Website and will not be able to monitor its performance. You may opt-out of having your activity on our Website made available to Google Analytics by installing the Google Analytics browser add-on. 

  • Pixels. A pixel is an HTML code snippet embedded in a website or email that collects information about user behaviors and interactions with the website or email. We may utilize pixels both on certain aspects of our Website and in HTML-formatted email messages to you. Pixels may be used for the purpose of, among other things, measuring the success of our marketing campaigns, compiling statistics about usage of our Website and tracking the activities of users of our Website and email recipients. For instance, we may use pixels from Meta on our Website to enable us to create targeted advertisements and measure the effectiveness of our advertisements. We also allow third party companies such as Google Analytics to place beacons, cookies or tags on our Site. Google Analytics utilizes cookies to gather information regarding use of our Site, which Google uses to generate reports for us regarding our Site. NOTICE OF BIOMETRIC INFORMATION COLLECTION

This Notice of Biometric Information Collection (this “Notice”) outlines Rookie’s practices for collecting, using, storing, retaining, and destroying Biometric Information (defined below) we collect from you (the “Customer”). “Biometric Information” means information based on biological characteristics collected that can be used to identify a person or as otherwise defined by applicable state law. 

If you use SafeSize’s state-of-the-art 3D foot scanning technology (“Technology”), your Biometric Information will be collected and stored by Rookie or SafeSize as the service provider. The Technology allows you to analyze your foot anatomy to reconstruct the exact foot shape and detect detailed foot dimensions. Your Biometric Information is used to provide you tailored recommendations of shoe brand, style, and/or size. 

Rookie will not disclose or disseminate your Biometric Information to any third-party, other than SafeSize, and will contractually prohibit SafeSize from disclosing or disseminating such Biometric Information, without your prior written consent, unless required by any state or federal law, municipal ordinance, valid warrant or subpoena, or other regulatory inquiry. 

Rookie will retain, and will require SafeSize to retain, your Biometric Information for no more than twenty-four (24) months after your last use of the Technology. We will permanently delete your Biometric Information from our records upon expiration of the retention period and will require SafeSize to do the same. We may retain your Biometric Information as necessary to meet our regulatory and legal obligations or to comply with law enforcement, a court order, or to complete a financial transaction requested by you. 

Rookie shall, and shall require that SafeSize, (i) implement and maintain industry reasonable technical and organizational measures for the storage, transmission, and protection from disclosure of all Biometric Information, and (ii) in a manner that is the same as or more protective than the manner in which we store, transmit, and protect other confidential and sensitive information. 

HOW WE USE INFORMATION

When you purchase items from the Rookie KIDS website, we will use your information to process the order, as well as to contact you if we have any questions or concerns about your order and to provide shipping confirmation. We also use your Personal Information to support our business operations. Examples include: 

  • To provide and deliver products, fulfill orders and process returns or exchanges; 

  • To establish and manage business relations with you; 

  • To respond to inquiries, requests or comments that we receive; 

  • To operate, improve and personalize the products and services we offer and improve, diagnose problems with, and administer the website; 

  • To communicate special offers, promotions, newsletters and information about Rookie and via email or your mailing address; 

  • To understand your product needs and preferences and market products to you that we believe may be on interest to you; 

  • To prevent or investigate activity that we think may be potentially illegal, unlawful, fraudulent, or harmful;  

We may provide you with promotional offers and other marketing communications by email unless you opt out of receiving such communications from Rookie KIDS. If you wish to receive these kinds of communications by text message, please “opt in” to receive them by indicating your preference in one of our stores or in our online contact forms. At no time are you obligated to provide us with any Personal Information in order to use and enjoy our website. It is Rookie KIDS’ policy to collect only that information that Rookie Shoes needs to meet our customers' needs, conduct our business efficiently, and communicate special or specific offers to you. If you do not wish to provide Rookie KIDS with your Personal Information, you will not receive certain communications and, you will not be able to purchase items on our website without providing your Personal Information. If you agree to receive mobile text coupons or other mobile text communications from Rookie KIDS, you agree that Rookie KIDS may send any information, including promotional or marketing text messages, via text message to the phone number you provided. You are not required to consent to receive text messages in order to make a purchase from Rookie KIDS in the future. If you want to stop receiving text communications from Rookie KIDS, please see the “Opt Out Policy” section below for instructions on how to opt out. 

HOW WE SHARE INFORMATION

In connection with the uses outlined in this Policy only, Rookie KIDS may share your information with our website hosting partners, vendors, subcontractors, agents, consultants and other service providers (“Service Providers”) to perform functions on our behalf when such sharing is required for the Service Provider to perform their functions on our behalf or to permit us to perform our functions. We do not sell any Personal Information concerning our users. We may also release your personal information to comply with the law or to protect our or others' rights, property, or safety. As with any business, it is possible that as our business develops, we may sell or buy online stores or other assets. In such transactions, information concerning customers often is among the transferred assets. Accordingly, in the unlikely event that our company or substantially all of our assets are acquired by a third party, such information may be one of the transferred assets. Rookie KIDS values the privacy of its customers and visitors to this website. Therefore, Rookie Shoes endeavors to comply with relevant ethical standards in gathering, using and safeguarding customer information that is entrusted to Rookie KIDS. Please note that, despite our diligence, new technology is constantly evolving and Rookie KIDS cannot immediately implement all new technology upon development.

The website may contain links to websites maintained by third parties with which we have no affiliation, such as social media platforms. This Statement does not reflect the privacy practices of those sites, and you should consult the privacy policies of those sites to learn about their practices. A link to any third party site does not mean that we endorse it or the quality or accuracy of information presented on it. 

CONTESTS AND SWEEPSTAKES

If you participate in one of our online contests or sweepstakes, we may use your information to further update you on the promotion in which you participated. If you “opt in” for communications from Rookie Shoes, we will use the contact information you provided to send you promotional information, coupons or other communications. Online purchasers and participants in contests, sweepstakes and promotions may also be included on our “opt in” list. If you submit any or post one or more text comments (such as user reviews), photographs or other information during a contest or sweepstakes (“User Content") on the Rookie Web Site we do not guarantee any confidentiality. However, we will not share any User Content with any third parties except as set forth above or in accordance with the Terms of Use. 

OPT OUT POLICY

If at any time you no longer wish to receive communications from us, you are free to “opt out” of receiving these communications. 

a) E-mail Communications. If you would no longer like to receive e-mailed coupons, special events information, sales notifications or other messages from Rookie KIDS, please click and follow the “Unsubscribe” instructions in your e-mail. Your e-mail address and other personal information will be removed from our marketing list. OPTING OUT OF RECEIVING E-MAILS WILL ONLY AFFECT YOUR RECEIPT OF MARKETING OR PROMOTIONAL E-MAILS. YOU MAY STILL RECEIVE TRANSACTIONAL EMAILS AND MESSAGES FROM Rookie KIDS VIA TEXT MESSAGE OR OTHER METHODS TO WHICH YOU HAVE PREVIOUSLY CONSENTED TO RECEIVE. 

POLICY CHANGES

Rookie KIDS reserves the right to change our Policy as our business changes. If this Policy changes, we will post an updated Policy on our website. You can tell if this Policy has changed by checking the revision date and version number that appear at the end of this Policy. To assist you in acquiring additional information, the Rookie KIDS site may have links to websites operated by third parties. Those websites will have their own policies on privacy that you may wish to review. Rookie KIDS has no responsibility concerning the content or operation of these linked websites. 

CALIFORNIA PRIVACY RIGHTS

Under California’s “Shine the Light” law, California residents who provide Personal Information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us once a calendar year information which includes a list of all third parties to which Rookie Shoes has disclosed Personal Information, as defined in California Civil Code Section 1798.83(e) during the preceding year, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year. California residents may request this information in writing by contacting us by email tocustomercare@rookiekids.com with “California Privacy Request” in the subject line. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. Please allow up to thirty (30) days for a response. 

HOW WE RESPOND TO "DO NOT TRACK SIGNALS"

Some browsers have an optional Do Not Track (“DNT”) feature that allows you to express your preference regarding tracking of your online activity by websites. When you choose to turn on the DNT setting in your browser, your browser sends a special signal to websites, ad networks, plug-in providers, and other web services you encounter while browsing to stop tracking your activity via cookies or other tracking technologies. Our Site does not currently respond to DNT browser signals or mechanisms. 

CHILDREN'S POLICY

Rookie KIDS is dedicated to protecting the privacy of all of its customers, especially children under the age of 13. Additionally, the Children’s Online Privacy Protection Act (“COPPA”) requires that we inform parents and legal guardians about how we collect, use, and disclose Personal Information from children under the age of 13. COPPA also requires that we obtain the consent of parents and guardians in order for children under the age of 13 to provide certain information to us. 

The following is an explanation of our policies regarding collection of information from children under the age of 13. The term “child” or “children” below refers to such children under the age of 13 and the term “parent” below includes legal guardians. 

(a) Collection of Information. In connection with certain online sweepstakes, contests and promotions only, Rookie KIDS may knowingly collect Personal Information from children. In such event, the information collected will be limited to the child’s name, photograph, biometric image (as set forth above), age, address, e-mail address and the e-mail address of his or her parent. Pursuant to applicable laws, Rookie Shoes will not condition a child's participation in any online activity on the child providing more Personal Information than is reasonably necessary. Additionally, Rookie KIDS may collect and use (i) materials (such as drawings) created by the child/children who participate in contests and (ii) a photograph of the winning child/children if we receive express consent of the parent to do so. All information will be collected by the active submission of such information by the child or parent, and not through the use of cookies or beacons. 

(b) Use of the Information and Disclosure to Third Parties. If a child registers for a sweepstakes or other promotion, we use the parent’s e-mail address to notify the parent of the child’s registration request and obtain parental consent (see below). All other Personal Information collected from the child will be used for the express purpose of operating the sweepstakes or promotion only, which may include notification to the child regarding rules and results of the sweepstakes and/or e-mail messages to the child regarding in-store or online promotions. In connection with such use only, we may share the child's Personal Information with our website hosting partners and certain third-party marketing services firms, as necessary. These parties have agreed to maintain the privacy and security of the Personal Information. In addition, we may share a child’s Personal Information with third parties to the extent reasonably necessary to: protect the security of integrity of our sites; to take precautions against liability; to respond to judicial process; or to the extent permitted under provisions of law, to provide information to law enforcement agencies or for an investigation related to public safety. Except for the limited disclosures described in this paragraph, we will not make any public disclosure (on our website or a chat page, for example) of any Personal Information provided to us by a child. As provided in the “How We Use Information” and “How We Share Information” sections above, we do not sell any Personal Information concerning our users. Presently, no child's personal information is disclosed to third parties. 

(c) Parental Consent. If Rookie KIDS has actual knowledge that any child under the age of 13 has attempted to provide any Personal Information, we will send an e-mail to the parental e-mail address provided to us, and allow the parent to verify the child’s submission (and our subsequent collection and use for a stated purpose) of Personal Information. If the parent does not consent to allow the child's submission (and our subsequent collection and use for a stated purpose), we will promptly delete the child's information from our database. If for any reason, the e-mail sent to the parental e-mail address is undeliverable or we receive no response after a reasonable period of time, we will delete the child’s submission as if the parent refused the child’s submission. In the event a child wins a sweepstakes or contest, and we want to publicize the name (and/or other Personal Information) of such child, we will again notify the parent at the parent's e-mail address and request that the parent provide his or her name and address for delivery of the applicable release and consent form. We will not publish or release the name or other Personal Information of any child as a winner of any contest without the express written consent of the child's parent. 

(d) Review and Deletion of Information. A parent can contact our customer service department at any time to review, change, or delete the Personal Information that we have collected from his or her child, or direct Rookie KIDS not to collect any further information about their child. A parent may also expressly request that a child's information not be shared with those limited third-parties with which we may share information, as necessary (and except as may be required pursuant to applicable laws), pursuant to (b) above.
